Terms of Service

Effective date: November 26th, 2024

Welcome to YourSitee ("YourSitee"). Let’s get to it.

The following Terms of Service ("Terms") are designed to help you clearly understand the rules and expectations for using YourSitee's services ("Services"). We’ve tried to use simple, understandable language, but since these Terms also contain legal obligations, we had to include some contractual formatting in certain sections. Please take the time to read through them carefully.

YourSitee provides a platform for showcasing your professional online presence in one place, in an aesthetic and organized way. Our goal is to ensure that everyone can use the platform easily and securely. YourSitee is all about self-expression and online creation, so to protect our community, we want to clarify what we expect from one another.

In order to use our Services, you must first accept these Terms. This will occur during registration, as well as in the case of any significant future changes. The Terms of Service, Community Standards, and Privacy Policy together make up the "User Agreement", which clearly defines the expectations and obligations related to the platform’s operation. If you have any questions about the Terms, please feel free to contact us, as our goal is transparency and your safety.

If you do not agree to the User Agreement, unfortunately, you will not be able to use YourSitee’s services.

1. Change of Terms

We may need to change these terms and conditions from time to time to keep this document fully up to date with changes to the platform, including if we decide to discontinue any feature, functionality or part of the platform, for legal or commercial reasons or otherwise to protect our legitimate interests.

We may make these changes without formal notice to you. You acknowledge and agree that it is your responsibility to review the Terms of Service from time to time to become aware of any changes. Your continued use of the YourSitee following any changes to the Terms will constitute acceptance of the revised Terms. If you do not agree to the changes, please stop using YourSitee and delete your account.

2. Our Services

Our Services are not available to individuals under the age of 16. If you are under 16, you may only create an account and use the Services if the laws of your country of residence allow for a lower age and that age is no less than 13. Under no circumstances may individuals under 13 create an account or use the Services. Additionally, you must be legally capable of entering into a contract, including giving consent for data processing in your country.

It is important to note that we don't collect data regarding your age, and therefore cannot verify it. As such, if you do not meet the following conditions, you are prohibited from registering until you fulfill them. This is essential to provide all users with a safe and positive experience.

By using the Services, you affirm that you are able to enter into a legally binding contract with YourSitee and that you will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

3. Accounts

To use the Services, you’ll need to create an account. Just follow the in-dashboard steps to do so. Here’s some important info about your YourSitee account:

General

Each of us is unique, and so should your account be. This means:

  • You can only create an account with a real, working email address.
  • You can't create an account using someone else’s identity — that’s not cool and it’s illegal.
  • You can't create a new account if you've been permanently banned.

There's no limit on how many accounts you can create, but spam accounts are forbidden and will be removed. As long as your accounts are configured and active, you’re good to go!

Email

When you create an account, you’ll need to provide an accurate, non-temporary email address. This ensures we can send important account info or help you regain access if needed. Using a fake or temporary email could result in losing your account. Make sure to keep your email address up to date through the YourSitee dashboard.

Password

You're responsible for maintaining the security of your email and password to prevent unauthorized access to your account. Never share your password, even with our staff — we will never ask for it. We strongly recommend using a unique password that hasn't been used elsewhere. Consider using randomly generated passwords with special characters, and a password manager for added security.

Username

When creating your account, choose a username that complies with our Community Standard. This name will appear when you use the Services. Most of the information in your profile is public and visible to both users and non-users of the Services. Your profile’s visibility may expand based on your use of YourSitee.

Notifications

Notifications about your account will be sent to the email address you provide or shown in the YourSitee dashboard. You can also opt into our newsletter, which you can unsubscribe from anytime.

4. Content

"Content" includes all user-generated material you create, upload, or publish on YourSitee, including but not limited to text, images, videos, music, and links.

You are responsible for the content you post on the platform, including its legality, reliability, and appropriateness. By posting content on YourSitee, you explicitly give us permission to store, use, distribute, copy, publicly display, and translate your content on the platform. YourSitee is free to use any feedback, comments, or suggestions you may provide regarding our Services. We can use them to develop any materials, items, features, or other Services.

You agree that we may, at our discretion, remove some or all of your content for any reason. This could include violating these Terms of Service or the Community Standards, or if the content is deemed harmful or otherwise inappropriate for the platform.

Usernames created on YourSitee must not be vulgar, sexually explicit, or contain offensive language.

If you create too many pages that are solely for SEO purposes or link to similar content for other reasons, it will be considered spam, and we will remove it, even if the page would otherwise be acceptable.

Recreating pages that were previously removed for the above reasons (except those removed due to inactivity) may result in a permanent ban from the platform and all related services.

You are responsible for backing up your content, as we do not offer publicly available backup services. We are not liable for any lost content, including content lost due to accidental deletion by the user or system failures.

What We Can Do with Your Content

By posting content on the platform, you grant us the right and license to use and display it. By sharing your content on YourSitee, you give us permission to freely use, publicly display, and distribute it within the Service, and you confirm that you have all necessary third-party rights and permissions to do so. You retain all rights to the content you submit, post, or display on or through the Service, and you are responsible for protecting those rights. You agree that this license includes making your content available to other users, who may also use your content in accordance with these Terms of Service. This license also allows us to watermark the uploaded content. With your explicit permission, we may also use your content for YourSitee’s marketing and promotional purposes.

The content you post is yours, or if you use third-party materials, you have the rights to share them on YourSitee (and you grant us permission to use them in accordance with these Terms).

Your Responsibility

You are responsible for your content and guarantee the following:

  • Your content does not violate anyone’s privacy, publicity, intellectual property, or other rights.
  • Your content is accurate and honest: it must not be misleading, deceptive, unlawful, or harmful to our reputation.
  • Your content does not contain harmful elements like viruses or disruptive code that could damage the platform or other systems.
  • Your content does not include automated data collection tools: do not use scripts or scraping tools to collect information from profiles or the Service.
  • You will not post unauthorized advertisements, endorsements, or promotions on YourSitee.
  • Your content complies with our Community Standards.

5. Links to Other Sites

Due to the link-sharing nature of the Service, pages on our platform often contain links to third-party websites. When you click on a third-party link, you will be redirected to that website (or its app version). Please note that we do not operate these external sites. Content posted by YourSitee users is generally not pre-screened by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party websites or services.

Additionally, the inclusion of links to external websites does not imply that we endorse those sites. You acknowledge and agree that when accessing other websites online, you do so at your own risk. It is your responsibility to review the terms of service and privacy policies of any third-party websites or services you visit.

6. Intellectual Property Rights

All intellectual property rights, including copyrights, patents, trademarks (both registered and unregistered), trade names, and other similar rights worldwide, belong to us. This includes rights related to inventions, designs, software, know-how, and anything created in industrial, scientific, or artistic fields. Using our services does not mean we are transferring any of these rights to you. Our trademarks and trade names cannot be used for any product or service without our written permission, and nothing in these terms transfers any of our intellectual property rights to you.

You are permitted to use the service only in ways that we authorize. This means you are granted a limited, non-exclusive, revocable, and non-transferable right to use the service for creating, displaying, uploading, and interacting with content in accordance with these terms. However, you must not use the service in connection with any product or service that is not affiliated with us or in a way that could harm our reputation.

We are not responsible for any content, opinions, advice, or offers expressed by other users. Any content made available by other users reflects the views of those individuals, not us.

If we provide you with any images, icons, videos, graphics, or other content (referred to as "YourSitee Content") for use with the service, you are only allowed to use this content on your page within our service, not elsewhere. You must also comply with any guidelines or terms associated with the use of this content, which could include third-party guidelines where applicable.

7. Our Rights, Your Rights

YourSitee gives you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable license to access and use our services. This license is strictly to help you enjoy the benefits of our services in line with these Terms.

Our services are meant for humans only—no AI, bots, or automated systems allowed!

You are not allowed to copy, modify, distribute, sell, or lease any part of our services. You also can’t reverse-engineer or try to extract the source code of any of the software that powers our services, unless the law allows it or we give you written permission.

We respect the rights of others, and we expect the same from you. This means you must not use the services, or let anyone else use the services, in any way that:

  • Violates or infringes on someone else’s rights to privacy, publicity, copyright, trademark, or other intellectual property rights;
  • Bullies, harasses, or intimidates others;
  • Defames anyone;
  • Spams or solicits other users. Our services are designed to be a safe space for everyone to enhance their digital presence.

Likewise, you must respect the rights of YourSitee. These Terms do not give you the right to do any of the following (or allow anyone else to do so):

  • Use any of our branding, logos, designs, photos, videos, or other materials used in our services;
  • Copy, archive, download, upload, distribute, broadcast, perform, or display any part of our services or content, unless it’s allowed under these Terms;
  • Use the services, tools, or content for any commercial purposes without our consent.

8. Fees for use

YourSitee is a freemium subscription-based service that offers both free and paid packages to our users. All subscription fees for the Services are billed on a monthly or recurring annual basis until cancelled based on the subscription selected. Switching between active packages is done on a pro rata basis for both upgrades and downgrades, based on the unused time remaining on the package. For this reason, it is possible to avoid incurring a new load until it is needed if sufficient previously charged credits can be applied when switching packages.

To cancel, please visit your billing page. To the extent permitted by applicable law, payments are non-refundable. But sometimes your claims may change. We do not provide refunds for subscriptions, including unused time on your account, except for accidental updates or forgotten subscription renewals if reported within 24 hours.

You agree that we may delete, terminate or disable any site, account or subscription for any reason, in our sole discretion, without formal notice to you, as set forth in these Terms of Service. You agree that we shall not be liable to you or to any third party for any such termination.

We reserve the right to change the prices of our subscription packages in the future. Users with active subscriptions will be notified by email at least 60 (i.e. sixty) days before the next billing cycle in which the changes will take effect.

Costs incurred on the platform do not include taxes, duties or levies imposed by international tax authorities and you may be responsible for paying these, if applicable in your jurisdiction.

Free Trial

We may offer a complimentary 30-day trial to new users who register for our services during promotional periods. Please note that the free trial is not always available to all users. Individuals who have or have had a subscription are not eligible to begin the free trial period. At the end of the free trial period, the user will be charged according to the subscription plan selected.

9. Third Party Services

If you use any services, features, or functionality provided by a third party through our platform (including services we offer in partnership with them), the terms of each party will govern your relationship with them. This means YourSitee’s terms apply to our services, and the third party’s terms apply to theirs. YourSitee is not responsible or liable for the terms or actions taken by any third party under their own terms.

10. Account Suspension or Cancellation

If you violate these Terms, our Community Standards, or any other policies we link to, we may need to suspend or cancel your account, or make changes to how you use the Service. For example, if you miss a payment, we might move you from a paid plan to a free one with fewer features.

The action we take will depend on the severity and frequency of the issue. In some cases, we may not suspend or cancel your account right away, but for repeated or serious violations, those steps are more likely. While we usually try to give you notice before suspending or canceling your account, we are not obligated to do so.

Please note that any fees you've paid in advance won’t be refunded. Additionally, we aren’t responsible for any loss of content or functionality that occurs if your account is suspended, cancelled, or downgraded to a free plan.

If you think your account was canceled by mistake or have concerns about these Terms or the Services, please contact us at [email protected]. We will make a good-faith effort to resolve any issues.

To protect you, other users, and the Service itself, we may temporarily suspend your account if we detect unusual activity that could pose technical or security risks. You can also choose to delete your account at any time via the settings within the Service.

11. Your Privacy

Your privacy is important to us. To understand how we handle your personal data when you use our Services, please take a moment to read our Privacy Policy. It’s important!

12. Our Standards

Our Community Standards define what content is and is not allowed on YourSitee, so please make sure you comply with them or we may suspend or permanently remove your account. By continuing to use the Services, you acknowledge and agree to the terms of these policies.

13. Recommended Content

YourSitee may suggest Sitees or other content that may be interesting to you as a user of certain YourSitee features. These recommendations are in no way an endorsement of the products or content by YourSitee.

14. Modifying the Services and Termination

We’re always working to improve our services. As part of this process, we may add or remove features, or even suspend or discontinue certain Services. We can make these changes at any time and will do our best to notify you in advance, though we’re not obligated to do so.

While we hope you stay with us for the long term, you can end these Terms at any time by deleting your account.

YourSitee also reserves the right to terminate these Terms if you violate them, break the law, or due to circumstances beyond our control. Although we aim to provide advance notice, we can’t guarantee it. Termination may include stopping our Services to you or adding new restrictions on your use. For instance, we might deactivate your account if it remains inactive for 24 months.

15. Indemnification

To the fullest extent allowed by law, you agree to indemnify, defend, and hold harmless YourSitee, along with our affiliates, directors, officers, shareholders, employees, licensors, suppliers, and agents, from any complaints, claims, damages, losses, costs, liabilities, and expenses (including attorney fees) that arise from or relate to: (a) your access to or use of the Services; (b) your Content; and (c) your violation of these Terms.

16. Disclaimers

We want to make a few important disclaimers. When you use YourSitee and interact with any content on the Service, you do so at your own risk. The Service is provided "as is" and "as available" without any warranties, whether express or implied. This includes, but isn’t limited to, uptime, availability, and implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance.

YourSitee, its affiliates, and its licensors do not make any promises or guarantees, whether express or implied, that:

  • the Service will be uninterrupted, secure, or available at any specific time or place;
  • errors or defects will be corrected;
  • the Service will be free from viruses or harmful components;
  • the Service will perform efficiently, or that it will meet your specific needs;
  • any content on the Service (including user content) is complete, accurate, reliable, appropriate, or available for any particular purpose.

These Terms apply to the fullest extent allowed by law, and nothing here is meant to exclude, limit, or modify your statutory rights that cannot be altered by contract. If these Terms are subject to Hungarian Consumer Law, our liability for breaching a consumer guarantee is limited to re-performing the Service.

If the laws of your country do not allow the exclusions of liability outlined in this clause, those exclusions will not apply to you.

YourSitee and our affiliates are not responsible for, nor do we assume liability for, any content created, uploaded, posted, sent, received, or stored by you, other users, or third parties through our Services. You understand and agree that you may come across content that could be offensive, illegal, misleading, or otherwise inappropriate, and YourSitee, along with its affiliates, will not be held responsible for such content.

However, nothing in these Terms will limit or exclude our obligation to remove content if required by the laws of your country.

17. Limitation of Liability

YourSitee, along with our affiliates, directors, officers, shareholders, employees, licensors, suppliers, and agents, will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, including any loss of profits, revenue, data, use, goodwill, or other intangible losses. This includes situations resulting from: (a) your use of, or inability to use, the Services; (b) your access to, or inability to access, the Services; (c) the actions or content of other users or third parties on or through the Services; or (d) unauthorized access, use, or alteration of your content.

In any case, YourSitee and its affiliates' total liability for all claims related to the Services will not exceed the fees paid by you to us in the 12 month period before the liability arises.

If the laws of your country do not allow any of the limitations of liability mentioned in this clause, those limitations will not apply to you.

18. Dispute Resolution

If you have any concerns, we would love to hear from you. Please reach out to us via [email protected], and we’ll do our best to resolve the issue together.

19. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of Hungary, where our offices are located. By using our Services, both parties agree to submit to the exclusive jurisdiction of the courts in Hungary.

If we don’t enforce any part of these Terms, it doesn’t mean we’re waiving our rights. If any provision of these Terms is found unenforceable, then that provision will be severed from these Terms and not affect the validity and enforceability of any remaining provisions. These Terms represent the entire agreement between you and us, replacing any previous agreements related to the Services.

Additionally, in compliance with Article 14 of Regulation (EU) No. 524/2013, the European Commission provides an online dispute resolution platform, which offers an independent way to resolve disputes between consumers and businesses within the EU outside of court. You can access this service at: https://webgate.ec.europa.eu/odr/.

20. International Use

Access to the Services from outside Hungary is at the user's own initiative and the user is solely responsible for compliance with applicable local laws. Although the Services is accessible from all over the world, we don't recommend that the materials on it are appropriate or suitable for use where the content is prohibited and should be avoided in such cases.

21. Your Feedback

When you provide YourSitee with comments, suggestions, recommendations, or other feedback ("Feedback"), you grant us a non-exclusive, perpetual, irrevocable, and transferable license to use that Feedback without any restrictions, attribution, or compensation to you. You also irrevocably waive, and agree to have waived, any claims or assertions of moral rights or other intellectual property rights in that Feedback against YourSitee and its users.

22. Confidentiality

At times, we may share confidential information with you (for example, if you participate in one of our volunteer YourSitee community programs, we may reveal new and upcoming features). If we share confidential information about YourSitee or our Services, you are required to keep it secret and secure. You must take reasonable steps to prevent others from accessing it.

If you're participating in a volunteer YourSitee community program and we’re okay with you sharing certain information publicly, we’ll let you know.

23. Final terms

Before you start using YourSitee, here are a few final important points:

  • These Terms don’t create or grant any rights to third parties.
  • If we don’t enforce any part of these Terms, it doesn’t mean we’re waiving our rights.
  • We reserve all rights not expressly granted to you.
  • You cannot transfer any of your rights or obligations under these Terms without our permission.
